These Terms of Use (“Terms”) govern your access to and use of the websites and services provided by Packless Camping LLC (“Packless Camping,” “we,” “us,” or “our”), including www.packlesscamping.com and related sites, content, products, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms, including the referenced Liability Waiver and Equipment Rental Agreement. If you do not agree to these Terms, do not access or use the Service.

1. Agreement to Terms

Your use of the Service, including placing bookings and purchasing camping kits, constitutes acceptance of these Terms, the Liability Waiver and Assumption of Risk located at: https://www.packlesscamping.com/liability-waiver, and the Equipment Rental Agreement located at: https://www.packlesscamping.com/equipment-rental-agreement

These linked agreements are incorporated by reference and form legally binding parts of these Terms.

2. Eligibility

You represent that you:

  • Are at least 18 years old;

  • Have full legal capacity to enter into binding contracts;

  • Will comply with all applicable laws and regulations in your use of the Service.

3. Use of the Service

Packless Camping provides a platform to book camping gear kits for designated parks, subject to availability, payment of applicable fees, and compliance with these Terms and the referenced agreements. You may not use the Service for any unlawful or prohibited purpose.

4. Account Registration

You agree to:

  • Provide accurate, current, and complete information;

  • Maintain and promptly update your account information;

  • Safeguard your account credentials;

  • Be responsible for all activities under your account.

Packless Camping may suspend or terminate accounts that are fraudulent, inactive, or in violation of these Terms.

5. Orders, Payments, and Deposits

• All orders are subject to acceptance by Packless Camping.
• You agree to pay all fees at checkout.
• Security deposits, as referenced in the Equipment Rental Agreement, may be collected separately via Stripe or another payment processor prior to delivery.
• All charges are in U.S. dollars.
• You are responsible for all applicable taxes.

6. Equipment Rental

Your rental of camping equipment is governed by the Equipment Rental Agreement at: https://www.packlesscamping.com/equipment-rental-agreement

You agree to:

  • Use the equipment only as intended and as permitted under applicable laws;

  • Return equipment in good condition, ordinary wear and tear excepted;

  • Be responsible for loss, damage, theft, or excessive cleaning costs as described in the Equipment Rental Agreement.

7. Assumption of Risk & Waiver

Your use of the equipment and participation in outdoor activities involves inherent risk. By booking and using the Service, you expressly accept the assumptions of risk and limitations of liability in the Liability Waiver and Assumption of Risk at: https://www.packlesscamping.com/liability-waiver

You hereby waive all claims against Packless Camping and its affiliates to the maximum extent permitted by law, except for those arising from gross negligence or willful misconduct.

8. Third Party Content and Links

The Service may contain links to third-party content and services. Packless Camping does not control or endorse these, and your use of third-party services is at your own risk.

9. Intellectual Property

All content, including text, images, graphics, logos, and software on the Service, is the property of Packless Camping or its licensors and is protected by U.S. and international laws. You may not use, copy, reproduce, distribute, or create derivative works without express written permission.

10. Termination

Packless Camping may suspend or terminate your access to the Service at any time for any reason. Upon termination, all rights granted to you will immediately cease.

11. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. PACKLESS CAMPING DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACKLESS CAMPING AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE SERVICE. PACKLESS CAMPING’S AGGREGATE LIABILITY SHALL NOT EXCEED AMOUNTS YOU HAVE PAID TO PACKLESS CAMPING IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Packless Camping and its affiliates from all claims, liabilities, damages, losses, and expenses, including attorneys’ fees, arising from your use of the Service, your breach of these Terms, or your violation of applicable laws.

14. Governing Law

These Terms and any disputes arising from them shall be governed by the laws of the State of California, without regard to conflict of law principles. You agree that all disputes will be resolved exclusively in the federal or state courts located in California.

15. Dispute Resolution

Arbitration: Except for small claims or injunctive relief, all disputes between you and Packless Camping will be resolved by binding arbitration under the rules of the American Arbitration Association.

No Class Actions: You agree that any arbitration shall be conducted on an individual basis and not as a class action.

16. Changes to Terms

Packless Camping may revise these Terms at any time. Changes are effective when posted. Your continued use of the Service after changes are posted constitutes your acceptance of such changes.
