RELEASE AND WAIVER

READ CAREFULLY — THIS IS A LEGAL DOCUMENT

By renting or using equipment from Packless Camping LLC, you (“Renter”) agree to the following Release and Waiver.

1. Assumption of Risk

Renter understands and acknowledges that camping and related outdoor activities involve inherent and significant risks, hazards, and dangers that can result in property damage, serious bodily injury, illness, or death. Such risks include, without limitation: slips, trips, and falls; uneven, unstable, or slippery terrain; exposure to weather, temperature extremes, sun, rain, wind, lightning, and changing conditions; encounters with wildlife, insects, and plants; fire hazards (including campfires, stoves, and fuels); water hazards; remote locations and limited access to medical care; equipment malfunction or failure; improper use of equipment; and physical strain, overexertion, dehydration, or other illness or injury. Renter further understands that risks may arise from the acts or omissions of Renter, minors or guests under Renter’s supervision, other participants, or third parties, and may be known or unknown, anticipated or unanticipated. Renter voluntarily and knowingly assumes all such risks, both known and unknown, associated with camping, outdoor activities, and the selection, pickup, transport, setup, use, and return of rented equipment provided by Packless Camping LLC.

2. Release of Liability

To the fullest extent permitted by law, Renter hereby releases, waives, relinquishes, and discharges Packless Camping LLC and each of its owners, members, managers, officers, employees, contractors, and agents (collectively, the Released Parties) from any and all claims, demands, causes of action, damages, losses, costs, expenses, or liability of any kind or nature, whether at law or in equity, arising out of or related to: (a) the rental, delivery, pickup, transport, setup, inspection, condition, use, or return of any equipment; (b) participation in camping or outdoor activities; and (c) any personal injury, illness, death, or property damage suffered by Renter or any member of Renter’s party. This release applies even if any injury, damage, or loss is alleged to have been caused in whole or in part by the negligence of any Released Party, to the extent permitted by California law.

3. Covenant Not to Sue

Renter covenants and agrees not to initiate, prosecute, or maintain any lawsuit, claim, arbitration, or other proceeding against any Released Party for any matter released in Section 2. If Renter breaches this covenant, Renter shall be responsible for the Released Parties’ reasonable costs and attorneys’ fees incurred as a result of the breach to the extent permitted by California law.

4. Responsibility for Others

Renter is solely responsible for the selection, pickup, transport, setup, safe use, and return of all rented equipment under Renter’s reservation and for ensuring that all minors and guests in Renter’s party use the equipment safely, in accordance with all instructions and warnings, and in compliance with this release and waiver. Renter represents that Renter has the legal authority to sign on behalf of any minors in the party and accepts this release and waiver on their behalf. This release and waiver applies to and binds all members of Renter’s party, including minors and guests, to the fullest extent permitted by law.

5. Medical Acknowledgment

Renter represents that Renter (and any minors or guests under Renter’s supervision) is physically capable of participating in camping and outdoor activities and using the equipment. Renter acknowledges that the Released Parties have not made any medical, health, or fitness representations or assurances, and that Renter is solely responsible for determining whether participation and equipment use are appropriate in light of Renter’s (and any minors’ or guests’) health and abilities.

6. Severability

If any term or provision of this release and waiver is held to be invalid, illegal, or unenforceable, such term or provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

7. Governing Law and Venue

This release and waiver is governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of or relating to this release and waiver shall be resolved in accordance with the dispute resolution provisions set forth in Packless Camping LLC’s Equipment Rental Agreement as in effect on the reservation date, and venue shall be as specified therein.

8. Acknowledgment

Renter acknowledges that Renter has carefully read this release and waiver, fully understands its terms, understands that Renter is giving up substantial legal rights (including the right to sue), and agrees to it freely and voluntarily without any inducement. Renter affirms that Renter is at least eighteen (18) years of age or the legal guardian of any minor(s) listed above and is signing on their behalf to the fullest extent permitted by law.
